Cash Back Terms & Conditions

Terms & Conditions:

1. Information on how to participate in the STIHL Cash Back promotion forms part of these Terms and Conditions. Claims that do not comply with these Conditions of Entry are ineligible. Internet access and a valid email account are required to redeem Cash Back claims. By redeeming a Cash Back claim, Participants agree to be bound by these Terms and Conditions.

2. STIHL Dealers, Employees of the Promoter, the immediate families of the Promoter and STIHL Dealers, and the affiliated companies and agencies of the Promoter and STIHL Dealers and their respective Employees, are ineligible to claim a Cash Back. Government Departments, Hire Companies and Direct Commercial Accounts (Key Account Holders) are eligible to claim. The STIHL Cash Back is only open to Participants. “Participants” means residents of Australia (other than the excluded persons set out in this clause 2), who purchase a qualifying Product from a participating STIHL Dealer during the promotional period. “Product” refers to any STIHL Product model mentioned within clause 4. “Double Dipper and Bonus Value” refers to the additional amount the customer will receive when spending their card at a STIHL dealership in one transaction. The STIHL Pre Paid Visa card value and Double Dipper value offered is for the sole and exclusive redemption on STIHL Products and Accessories (including bar, chain, sprockets, and excluding all other Spare Parts). The Promoter reserves the right to request the details of individual redemptions and proof of sale. By participating in this promotion, the Dealer accepts the full Terms and Conditions, and agrees to provide the Promoter, upon request; details of any transaction to validate that STIHL Products and Accessories (including bar, chain, sprockets, and excluding all other Spare Parts) were on-sold. It is the individual Dealer principle’s responsibility to ensure all their staff are fully aware and abide by these conditions.

4. To obtain a Cash Back (in the amount specified below for each Product), the Participant must purchase during the promotional period, (as set out in clause 5 below) one of the following STIHL products and their corresponding Cash Back amounts: MSA 160 T Chainsaw (for $75 Cash Back); MS 291 (for $75 Cash Back); MS 311 (for $75 cash back); MS 150 TC-E Chainsaw (for $75 Cash Back); MS 193 T Chainsaw (for $75 Cash Back); MS 201 TC-M Chainsaw (for $75 Cash Back); MS 201 TC-M PD 3 Duro Chainsaw (for $75 Cash Back); MS 391 (for $100 Cash Back); MS 241 C-M Chainsaw (for $100 Cash Back); MS 261 C-M Chainsaw (for $100 Cash Back); MS 261 C-MQ Chainsaw (for $100 Cash Back); MS 362 Chainsaw (for $100 Cash Back); MS 381 Chainsaw (for $100 Cash Back); MS 461 Chainsaw (for $150 Cash Back); MS 661 C-M chainsaw (for $150 Cash Back); and MS 880 Chainsaw (for $200 Cash Back); TS 420 Cutquik® (for $75 Cash Back); TS 420 A Cutquik® (for $75 Cash Back); TS 500i Cutquik® (for $75 Cash Back); TS 700 Cutquik® (for $75 Cash Back) and TS 800 Cutquik® (for $125 Cash Back). The Promotion is available while stocks last within the period specified in clause 5 below. Claims will not be accepted on Products purchased prior to the promotion start date, specified in clause 5. No rain checks.

5. Entries into the promotion are valid only for Products purchased and paid for in full in Australia from authorized and participating STIHL Dealers between 1st of April 2016 to 30th of June 2016 (inclusive, final claims must be lodged by 11:59pm on the 15th of July 2016). Participant(s) will forfeit claims not made by this date.

6. To lodge a Cash Back claim, the Participant must visit www.stihl.com.au/cashback and complete the official on-line claim form by entering their details, answering the associated questions and entering the unique serial number from their purchased Product and the unique code from the claim form issued at the place of Product’s purchase. Claims must be submitted via the STIHL internet site only. Claim forms sent via Post, facsimile or any other method will not be accepted.

7. Multiple claims are accepted. Each claim must include a unique serial number and a unique code for each separate item purchased. Each Product purchased can only be used once for redeeming the associated Cash Back. Claims will be deemed invalid if the same serial number and / or unique code are used on more than one claim. STIHL reserve the right to request that claimants present proof of purchase for Cash Back claim validation.

8. The cash back funds will be issued by Visa prepaid gift card. For full terms and conditions on the use of the card visit: ichoosegift.mycardplace.com. Card issued by Heritage Bank Limited ABN 32087652024 AFSL 240984 Australian Credit License 240984. Funds will be issued in Australian Dollars.

9. Please allow for up to 60 days from the date that the claim is validated for processing.

10. Participants must activate their STIHL Visa prepaid gift card when they receive it by going to ichoosegift.mycardplace.com prior to going in store. The card will be valid for 12 months from date of issuance.

11. Participants can qualify to double their Cash Back value by using the full amount on the Visa prepaid card towards the purchase of STIHL Product and Accessories (including bar, chain, sprockets, and excluding all other Spare Parts) at a Participating STIHL Dealer. The equivalent Double Dipper Value must also be used as additional Double Dipper Cash Back towards the total of the single transaction. For example, a $75 Cash Back card can be used to purchase STIHL Products and Accessories (including bar, chain, sprockets, and excluding all other Spare Parts) at a Participating STIHL Dealer to the value of $150. The ‘double Cash Back’ offer is only valid for the total value of card value and bonus value combined. If the purchase amount exceeds the combined value, the remaining balance can be paid by way of cash or another credit, debit or prepaid card. Part redemptions will not be accepted and the Visa prepaid card will only be valid for the initial value loaded i.e. $75. The additional bonus cash back promotion period is as stipulated in clause 5. The additional ‘Double Dipper’ Cash Back must be redeemed by 11:59pm on the 30th of September 2016; otherwise the card may be used until the expiry date shown on the card or the remaining balance is depleted.

12. Participants can check their card available balance and complete transaction history at any time free of charge online at: ichoosegift.mycardplace.com. Should the Participant wish to check their balance using the automated phone service, charges will apply and will be deducted against the card making the value of the card invalid for the Bonus Cash Back. Refer to the detailed card Terms and Conditions for charges applicable to the Visa prepaid card.

13. If a Participant claims the Cash Back offer and later returns or exchanges the Product and Accessories (including bar, chain, sprockets, and excluding all other Spare Parts), due to a defect in the Product and Accessories (including bar, chain, sprockets, and excluding all other Spare Parts), in accordance with law or the relevant STIHL Dealer’s Terms and Conditions of sale, then the amount refunded or credited to the Participant will be the amount paid for the Product, less the Cash Back amount.

14. The Promoter reserves the right to extend the closing date of the promotion at their discretion.

15. With the exception of ordinary Product discounts, in the form of in-store sales offered by STIHL Dealers, the promotion is not valid in conjunction with any other promotional offer.

16. The Promoter’s decision on all matters pertaining to this Promotion is final and binding and no correspondence will be entered into.

17. Claims are not transferable or assignable.

18. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, without limitation, indirect or consequential loss), or for a personal injury suffered or sustained, as a result of participation in this promotion, except for any liability which cannot be excluded by law.

19. The Promoter will use the information contained in the claim form to contact Participants if it has any queries regarding claims, and to send fulfilment of Cash Back Double Dipper claim.

20. The Promoter reserves the right to verify all entries. Entries are void if illegible, forged or tampered with in any way. No responsibility is accepted for late, lost or misdirected claims via the Internet.

21. The Promoter reserves the right, at its sole discretion to disqualify any claimant who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the promotion. The Promoter reserves its rights to recover damages or other compensation from such an offender.

22. To the extent permitted by law, the Promoter and its agents exclude liability for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any web site, or any unauthorised intervention, incorrect or insufficient supplied merchant identification parameters, or any combination thereof, including problems that prevents a Participant from obtaining a Double Dipper Cash Back, or which cause injury or damage to the Participant’s or any other person’s computer related to, or resulting from, participation or attempted participation in this promotion.

23. If for any reason this Double Dipper Cash Back redemption is not capable of running as planned including: infection by computer virus, bugs, tampering, requirement of a regulatory body, unauthorised intervention, fraud, technical failures, incorrect or insufficient supplied merchant identification parameters, or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration security, fairness integrity or proper conduct of this redemption, the Promoter reserves the right in its sole discretion, to cancel, terminate, modify or suspend this promotion.

24. The Promoter collects personal information about Participants for the purpose of including Participants in the promotion. Unless otherwise notified by the Participant to the Promoter in writing, in providing their personal details, each Participant agrees to the Promoter using their details for future marketing and publicity purposes, to the extent permitted by the law, and to the Promoter disclosing such information to third parties for this purpose. If any information requested is not provided, the purchaser may not participate in this promotion. All personal details of Participants will be stored in a database at the office of the Promoter or its Agencies. The Promoter is committed to the protection of personal information. A request to access, update or correct any information should be directed to the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information may be obtained online at www.stihl.com.au.
